Terms of Service — Lexicafe

These Terms of Service ("Terms") are a legal agreement between you and Yevheniia Beltser ("Lexicafe", "we", "us") governing your use of the Lexicafe application and website at https://lexicafe.app (the "Service"). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 16 years old. You sign in with Google; you are responsible for keeping your account secure and for all activity under it. You must provide accurate information and notify us of any unauthorized use.
2. The Service
Lexicafe is an AI-assisted vocabulary, translation, and language-learning tool. It generates translations, examples, descriptions, and answers, and offers spaced-repetition review and a lesson-analysis ("Listen") feature. We may add, change, or discontinue features at any time.
3. AI-generated content — no guarantee of accuracy
Translations, examples, definitions, and chat answers are produced by automated AI systems and may be inaccurate, incomplete, or unsuitable for your purpose. The Service is for educational and informational purposes only and is not professional, legal, medical, or certified-translation advice. Verify important information independently.
4. Your content
You retain ownership of the words, notes, transcripts, and other content you create ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to operate the Service for you (including sending it to the AI sub-processors described in the Privacy Policy). You represent that you have the rights to submit Your Content.
5. Acceptable use
You agree not to: use the Service unlawfully; submit others' personal or confidential data without authorization; attempt to overload, scrape, reverse-engineer, or circumvent quotas/security; resell or redistribute the Service; or use it to generate unlawful, infringing, or harmful content.
6. Recording and the Listen feature
You are solely responsible for complying with all laws when recording or transcribing audio, including obtaining any required consent from other people. Only record conversations you are legally permitted to record. We are not responsible for your use of recording features.
7. Your own AI API keys
You may optionally add your own OpenAI/Google API key. You are responsible for your key, its usage, and any charges your provider bills you. We use your key only to fulfill your requests and store it encrypted; we are not liable for your provider's costs, outages, or terms.
8. Plans, payments, and refunds
The Service may offer free and paid plans. Paid features (when paid plans launch) are billed through our payment processor (disclosed at checkout). Prices, billing cycles, taxes, and what each plan includes are shown at checkout. Subscriptions auto-renew until cancelled; you can cancel anytime, effective at the end of the current period. Refunds: in line with the EU consumer right of withdrawal where applicable. Free-tier AI usage is subject to daily quotas.
9. Intellectual property
The Service, its software, design, and branding are owned by us or our licensors. Except as stated here, no rights are granted.
Dictionary data. Some dictionary content is derived from Wiktionary / Kaikki and is licensed under CC BY-SA 3.0. Such content remains under that license, with attribution as shown in the Service.
10. Third-party services
The Service relies on third parties (Google, AI providers, hosting). Your use of those is also subject to their terms. We are not responsible for third-party services we do not control.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate or fit for any purpose.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data or profits. Our total liability for any claim is limited to the greater of the amount you paid us in the prior 12 months, or EUR 100. Nothing in these Terms limits liability that cannot be limited by law (e.g., certain consumer rights under EU/Ukrainian law, or liability for gross negligence/wilful misconduct).
13. Indemnification
You agree to indemnify us against claims arising from your misuse of the Service, your content, or your violation of these Terms or applicable law (to the extent permitted for consumers in your jurisdiction).
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service. On termination, your right to use the Service ends; your data is handled per the Privacy Policy.
15. Changes to these Terms
We may update these Terms. We will post the updated version and update the date; material changes will be communicated in-app or by email where appropriate. Continued use after changes means you accept them.
16. Governing law and disputes
These Terms are governed by the laws of Poland, without regard to conflict-of-laws rules. Disputes are subject to the courts of Poland, except where mandatory consumer-protection law gives you the right to your local courts.
